Beneficiary Visitor Policy Area 5

Protocol

With respect to all buildings utilized by Livanta as the Beneficiary and Family Centered Care Quality Improvement Organization, Livanta is a secure facility not open to the public. Medicare beneficiaries or their representatives may visit under the following circumstances:

  1. A written request is made at least two weeks in advance of the proposed visit and faxed to 301-490-1339, or mailed to:

  2. Proper authorization is submitted with the request, such as a copy of a driver’s license if the requestor is the beneficiary, or proof of representation (CMS Form-1696 or its equivalent) if the beneficiary’s representative is the requestor.

  3. A beneficiary requestor agrees to be limited to one named person who may assist in representation during the visit.

  4. For security purposes the requestor agrees to a security checkpoint search of the person(s) prior to entry.

  5. The requestor gives a valid reason for the visit. Currently, the only valid reasons are: To review closed case decision records in Annapolis Junction, Maryland, in accordance with 42 CFR 478.24 or to file an appeal or a quality complaint in Las Vegas, Nevada. If the request is to review closed case decision records in Maryland, then the case number and/or other identifying information, such as provider, dates of service, Medicare number, etc. must be supplied.

  6. The requestor proposes dates and times for the visit that are within the hours of 9 a.m. and 3 p.m. local time, Monday through Friday except federal holidays.

  7. All proposed visitors must agree in writing not to make any recordings while on the premises. Livanta does not permit recordings to avoid violations of the Health Insurance Portability and Accountability Act (HIPAA) and other federal, state, and local privacy regulations.

    Note: Livanta does not normally make any recordings of proceedings with visitors, but reserves the right to make recordings of the proceedings and will advise the visitor(s) prior to any recording. If Livanta makes a recording of the proceedings, a copy will be furnished to the requestor at cost within 10 business days of the meeting.

  8. For faster return notification, an email address or fax number is supplied (optional).

Livanta reserves the right to decline visitor requests for any reason, even if the above requirements are met. Livanta will consider all requests that include all of the above information and will provide a written reply to the requestor within 7 business days of the request, along with a calculation of the reasonable charge that must be paid prior to the visit if the visit concerns examining records of a case. The reasonable charge will include the cost of retrieving the records and a deposit for copying them. Any unused deposit will be refunded within 4-8 weeks of the visit.
